Harris County Bicyclist Hit, Killed by Driver
A driver who may have been intoxicated when his vehicle struck and killed a bicyclist is under investigation, according to authorities. The investigation stems from a recent fatal auto accident that claimed the life of a bicyclist on a Texas highway. The accident happened on Highway 6 near Empanada.
Investigators state that the bicyclist was traveling on the far side of the shoulder of Highway 6 when a red truck struck him. It is further alleged that the driver of the truck may have been intoxicated at the time of the accident. Witnesses report that the truck had been traveling along the shoulder, but no one seems to know exactly why.
Both the bicyclist and the truck were traveling south on the highway when the accident happened. The victim, only identified as a man in his late 40s, died in the accident. The driver of the truck has cooperated with police, and has stated that he attempted to swerve away from the bicyclist, but was unable to in time. Authorities are waiting for blood test results to confirm or deny intoxication before determining the course of any criminal charges against the driver.
A Texas Personal Injury Attorney can Help Win Financial Compensation
If the driver of the truck is found to have been intoxicated, then it may be presumed that he negligently got behind the wheel after drinking too much. Under Texas’ personal injury and wrongful death laws, the family of anyone killed in an accident cause by the negligence of another party may have the right to file civil claims against those parties. Successfully litigated civil claims could provide the surviving family of fatal auto accident with compensation for their pain and suffering, funeral expenses, lost wages or other losses sustained in the accident.
